Johnson et al<\/h2>\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"preface\">Timeline<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">In 2014, a small group of people founded the Satanic Temple of Seattle; Nathan Sullivan was one of those founders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Throughout 2016 and 2017, a young but nationally prominent member of the Seattle religious organization found themself sexually harassed by an older man also in the chapter. For months, the local leaders did nothing, and the young member eventually left in 2017.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2018, a group of Satanists in the South Puget Sound area of Washington State formed a group to be independent of but friendly with the Seattle organization. They created a Facebook page for this purpose under the name &#8220;South Sound Satanists&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In late 2019, the two groups merged and almost immediately the South Sound group&#8217;s leader was unilaterally expelled by two of the local Seattle leaders; the South Sound group was seized, including taking over its Facebook page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2020, the young member who was sexually harassed discovered and was upset to see their image was <em>still<\/em> being used by the local chapter to promote the org. Those images were finally removed, and the Chapter  assured them it wouldn&#8217;t happen again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In February 2020, a member of what had been the South Sound Saanists group expressed to another TST Washington member that he didn&#8217;t have faith in the current leadership of the Washington State group. He was unilaterally removed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In March 2020, a public stunt at the Washington State capitol involved TST members wearing makeup similar to what the young, sexually harassed former member had made famous. <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.chronline.com\/stories\/amid-pious-protesters-satanists-conduct-a-ritual-on-the-capitol-steps,4905\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/07\/image-33-1024x683.png\" alt=\"\" class=\"wp-image-2264\"\/><\/a><figcaption class=\"wp-element-caption\"><em>&#8220;Satanic ritual marchers are met by Christian protest and prayer.&#8221;<\/em> <br>Cameron Sheppard | WNPA News Service<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Rather than apologizing for further harm caused, intended or unintended, two local leaders began to call themselves &#8220;senior leadership&#8221;, claimed they were &#8220;democratic to a point&#8221;, and on March 12, 2020, dissolved the 20-plus-person democratic and volunteer committees in favor of a smaller group consisting of themselves, their partners, and their favored subordinates. They also said they had done nothing wrong, and anyone CC&#8217;d on the internal complaint against their handling of the situation had taken part in an attempted coup.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 14, 2020, they told local TST member Joshua Calavera he had been &#8220;fucking up&#8221; by using the re-purposed South Sound page (by then the &#8220;Memes page&#8221;) to say transphobia, racism, and white supremacy were bad \u2014 because, senior leadership said, this had nothing to do with Satanism. Calavera removed himself from the main Chapter page, but as admin of the Memes page, removed all the other admins and moderators from that Memes page and posted a statement declaring the page was no longer associated with the Temple and therefore was explicitly against &#8220;ableism, misogyny, and racism&#8221;, racists, transphobes, and all bootlickers who weren&#8217;t in it for the kink. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 14, 2020, TST&#8217;s local representatives told Calavera they were not interested in the Memes page and it was his &#8220;free and clear&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also on March 14, 2020, Nathan Sullivan  \u2014 despite creating it  \u2014 was one of a handful of people to discover he no longer had access to the local TST Discord server. This was the only form of communication Sullivan ever received that he was no longer a member of The Satanic Temple Seattle\/Washington after more than five years in the organization \u2014 up until the point he was served papers for a lawsuit weeks later. But the following day, March 15, a Zoom meeting confirmed that Calavera, people CC&#8217;d on an internal complaint, and any of those people&#8217;s partners had been expelled from TST Washington on suspicion of a coup.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the expulsions and explainer meeting, more people left the local chapter and began to share their stories of harassment and abuse, comparing notes where they had previously been isolated as well as highlighting issues present at the national level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 20, 2020, expelled TST Washington member and defendant David A. Johnson was still an admin of Washington State&#8217;s chapter page and did as Calavera had done, removing all other admins and moderators and announcing it was no longer connected to The Satanic Temple. Johnson posted news articles, former member testimony from other chapters, and TST owners&#8217; own words <a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/1\/6\/united-federation-of-churches-llc-v-johnson\/\">on the Facebook page<\/a>, along with <a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/1\/5\/united-federation-of-churches-llc-v-johnson\/\">criticism<\/a> of the way TST&#8217;s practices did not live up to their religious principles. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 3, 2020, The Satanic Temple began suing four \u2014 and only four \u2014 of the expelled people in federal court: Nathan Sullivan, Joshua Calavera, David A. Johnson, and Leah Fishbaugh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Feb. 26, 2021, the district court judge dismissed the case for the first time, with leave to amend some claims but dismissing the defamation claim with prejudice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 29, 2021, The Satanic Temple filed an amended complaint to continue the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Jan. 6, 2023, the district judge dismissed the case for a second and final time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Jan. 25, 2023, The Satanic Temple appealed their loss to the Ninth Circuit Court of Appeals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 5, 2023, The Satanic Temple filed a new case against the four defendants in King County Superior Court about the same issues previously dismissed in federal court from three years before.<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\">Preface<\/h1>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">&#8220;Wait, why is The Satanic Temple suing you?&#8221;<\/h2>\n\n\n\n<p class=\"has-larger-font-size wp-block-paragraph\" id=\"coverpage\">The Satanic Temple is suing four former members of the Seattle\/Washington State chapter because it is a hierarchical business <em>cum<\/em> religion owned by two men who cannot stand to be publicly criticized, particularly for their failure to live up to their own stated principles. <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\">Cevin Daniel Soling (&#8220;Malcolm Jarry&#8221;, &#8220;Calvin Soling&#8221;) and Douglas Alexander Misicko (&#8220;Lucien Greaves&#8221;, &#8220;Doug Mesner&#8221;) have demonstrated repeatedly that what they hate more than anything else is being confronted with the ways their propaganda falls short of reality. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No matter how many human rights crises rage around the country \u2014 many manufactured deliberately by self-described fascists and Christian theocrats \u2014 the thing that Misicko and Soling feel truly threatened by is having their religion publicly scrutinized on a basis more substantive than on the &#8220;heroic Satanist underdogs against mean Christians&#8221; narrative that raises hundreds of thousands of dollars each year for them, with merch sale profits tossed in on top.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-large is-resized\"><a href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/image.png\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/image-1024x490.png\" alt=\"[redacted name] But the question is, will you found an actual organization The Satanic Temple 2: Electric Boogaloo? TST&#8217;s legal assault on us is about as old as the Covid-19 pandemic itself, and it persists because The Satanic Temple wants to commit resources to extending it and because its owners are willing to repeatedly demand state-enforced compensation for damages predicated on overtly false allegations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And we want to be explicit about this in particular: <\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><a href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/06\/Satanic-Boogaloo-Court.png\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/06\/Satanic-Boogaloo-Court.png\" alt=\"111. Defendants\u2019 competitor organization, which was provisionally entitled \u201cThe Satanic Temple 2: Electric Boogaloo\u201d and \u201cSatanic Washington \u2013 Archived Temple Chapter\u201d had a likelihood of impairing the distinctiveness of TST as a famous mark. To-wit: (1) \u201cThe Satanic Temple 2: Electric Boogaloo\u201d directly copies \u201cThe Satanic Temple;\u201d and \u201cSatanic Washington \u2013 Archived Temple Chapter\u201d (emphasis added) directly suggests that the Washington Chapter has been replaced by Defendants\u2019 competitor organization. (2) TST has an inherently distinctive mark because there is only one \u201cThe Satanic Temple,\u201d Plaintiff, which has acquired distinctiveness as a mark through years of effort. Meehan, in conjunction with the other named Defendants, then began posting material in violation of the Code of Conduct and in disregard of the revocation of authority entailed in being removed from the position on the advisory council. \n38. Sullivan explicitly recognized that Defendants had no authorization to access the Allies page. On March 15, 2020, Sullivan publicly stated that he was no longer affiliated with TST. Exhibit 2. And, referring to the Allies page: \u201cwe have a meme page here that we stole from TST: Evergreen Memes for Queer Satanic Fiends.\u201d Id. at pp. 3-4.\" class=\"wp-image-1786\" style=\"width:500px;height:323px\"\/><\/a><figcaption class=\"wp-element-caption\">Source: United Federation of Churches LLC dba &#8220;The Satanic Temple&#8221; in First Amended Complaint for King County Superior Court (link) (May 30, 2023)<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">And then, when the case was dismissed from federal court, nobody forced TST to simultaneously appeal the dismissal in the Ninth Circuit and also repeat their claims in state court at the same time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All of these are decisions that TST&#8217;s owners have consciously and repeatedly made, and will continue to make as long as they&#8217;re allowed to without scrutiny. And there is every reason to believe that they will do it again to other people in the future.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These seem like big claims to make, and maybe even unwise ones to make given that we are currently already being targeted for a lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Well, if you stick with us through all of this, you will discover that the Temple and its operatives are both so malicious and incompetent, there is no shortage of receipts and outright admissions for all of these things \u2014 but also that the U.S. legal system is not a justice system, and rich people can file all of the lawsuits they want.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This write-up will be much more thorough than most will ever need. That&#8217;s fine. But it intends to shed much-needed daylight with every specific we can muster and document on what is possibly The Satanic Temple&#8217;s most sustained assault on that speech to date, and on the events that led up to it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When it comes to The Satanic Temple, there&#8217;s always more, and it&#8217;s always worse. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you don&#8217;t believe us yet, keep reading because you will.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading alignwide\" id=\"who-is-this-for?\">Who is this for?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"8480\">Ultimately, this writeup is intended to be <em>thorough <\/em>but not necessarily <em>comprehensive<\/em>, and certainly nothing close to neutral. We want to show what we believe are TST&#8217;s actual priorities as an institution, how those priorities reveal themselves in the Temple&#8217;s publicly-recorded decisions, who is affected most by the consequences of those decisions, and most importantly, what all of this says about TST&#8217;s relationship to the public interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"8480\">Of all of TST&#8217;s lawsuits, we naturally know this one the best, and we believe that it is one of the clearest examples we&#8217;ll ever have of what TST actually considers to be threats to itself, and what it considers to be a reasonable response to those threats. This writeup, as long as it is, is thus intended to be a sort of highlight reel; we want to focus on the most egregious and bad faith arguments that TST makes in this lawsuit, because we think that the very existence of those claims, and the fact that TST finds them compelling enough to present to multiple judges, highlights the Temple&#8217;s fundamentally predatory worldview towards its own members, towards the general public, and towards public institutions like the press and the legal system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We don&#8217;t expect anyone to simply take us at our word, though. We cannot emphasize enough that you should, in fact, examine the primary sources wherever you can: court documents, testimonials from other members and ex-members around the country, TST&#8217;s own recorded statements over the last decade of its existence and beyond. All we&#8217;ve done is compile them, do our best to make them as accessible as possible to as many people as possible, and then talk about what we believe are the patterns that emerge. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We think you deserve better. We think the entire world deserves better.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are a journalist wondering why so much mainstream coverage of The Satanic Temple keeps sounding the same, this article is for you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are an advocate for the separation of church and state, and want to know whether The Satanic Temple can be trusted to be on your side when it comes to religions demanding to wield the power of the state with minimal scrutiny, this article is for you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are an <a href=\"https:\/\/en.wikipedia.org\/wiki\/Exvangelical\">exvangelical<\/a> or other survivor of religious abuse, and want to know whether The Satanic Temple takes the root causes of that abuse seriously and takes care to avoid repeating them, this article is for you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are rightly horrified by the assaults on reproductive freedom and bodily autonomy by fascist legislators and local reactionaries, and are considering supporting The Satanic Temple as a theoretical counter to them, this article is for you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And last but not least, if you are a former member of The Satanic Temple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you joined with every intention of joining that ongoing struggle for justice \u2014 if you poured countless hours, if not years, of your life into helping realize the Satanic Temple&#8217;s purported missions only to be used, abused, and then disposed of by its lieutenants or regional leadership, and then harassed or threatened into silence so as to not endanger the Temple&#8217;s progressive reputation \u2014 if any of that is true, this article is for you.<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"introduction\">Introduction<\/h1>\n\n\n\n<p class=\"has-larger-font-size wp-block-paragraph\"><strong>These now <em>multiple<\/em> frivolous, incompetent lawsuits by The Satanic Temple against four former members is a rare window into what the so-called &#8220;bona fide religion&#8221; actually is<\/strong>: an abusive, predatory organization that actively targets the most vulnerable people in its reach. <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\">As TST&#8217;s whole campaign against us shows, it is an one actively willing to corrode the separation of church and state just to protect its ability to profit further from the exploitation of those people.<\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\" id=\"2a83\">In this three-year period, we have seen the first case <a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/20\/united-federation-of-churches-llc-v-johnson\/\">dismissed by a federal judge once in February 2021<\/a>, and <a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/48\/united-federation-of-churches-llc-v-johnson\/\">again in January 2023<\/a>. We have seen the Temple&#8217;s incompetent defamation claims refuted directly on the simple basis that the First Amendment protects the right to criticize a religion&#8217;s beliefs, and seen the original excuse for the case resolved back in May 2020 via Facebook ticket with no need for litigation at all.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/07\/Facebook-Page-Transparency.png\" alt=\"\" class=\"wp-image-2274\" style=\"width:435px;height:654px\"\/><figcaption class=\"wp-element-caption\"><a href=\"https:\/\/www.facebook.com\/TheSatanicTempleWashington\/about_profile_transparency\">Facebook page transparency as of July 2023<\/a><\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"has-large-font-size wp-block-paragraph\">Again: ostensibly this is all about The Satanic Temple claiming the Temple&#8217;s for-profit corporation&#8217;s owners \u2014 rather than the actual page admins or especially rather than Mark Zuckerberg and Meta corporation \u2014 own Facebook pages, and that any criticism of TST as a religion is <em>de facto<\/em> defamation because TST&#8217;s owners disagree with it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At any point, the Temple had the power to end this, even to declare victory at their retaliation being credible and efficacious, if they so chose. Instead, they appealed their federal court loss to a higher court and started a new lawsuit over the same issues in state superior court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We continue our fight to defend ourselves because we have to but also because it&#8217;s clear that if The Satanic Temple is not stopped here, they will grow into something even more dangerous and abusive. This is not a problem that will resolve on its own or that can be trusted to let someone else rescue us from.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider that since suing us, TST has now also <a href=\"https:\/\/queersatanic.com\/the-costs-of-defending-yourself-from-the-satanic-temple\/#newsweek\">sued <em>Newsweek<\/em> and its reporter as an individual<\/a> for writing about the case, and has even sued <a href=\"https:\/\/queersatanic.com\/today-is-a-good-day-for-the-satanic-temple-to-release-its-finances\/\">a Texas TikToker<\/a> who made two videos critical of the Temple. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TST and its loyalists have been shown more than willing to move the goalposts however much they feel is necessary in order to justify the existence of this suit, as they pursue it for over three years and in three different courts to date. Their justifications both in and out of court run the gamut: acording to them, we&#8217;ve stolen their property, committed cyberpiracy and fraud, and funneled away donations and members that TST was theoretically entitled to in order to prop up a competitor organization called &#8220;<strong><a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/26\/united-federation-of-churches-llc-v-johnson\/\">The Satanic Temple 2: Electric Boogaloo<\/a><\/strong>.&#8221; <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/image-1024x490.png\" alt=\"[redacted name] But the question is, will you found an actual organization The Satanic Temple 2: Electric Boogaloo? The Satanic Temple 2: The Second one? S2: The Mighty Satanists? Nathan Von Sullivan: Satanism Reloaded actually\" class=\"wp-image-1546\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/06\/Satanic-Boogaloo-Court.png\" alt=\"\" class=\"wp-image-1778\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">None of those claims have any factual or legal weight, and the court has so far repeatedly recognize this dearth. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this is always <em>expensive<\/em>, and TST continues to allege them and prop them up whenever they have to acknowledge this suit&#8217;s existence because ultimately, no matter no matter how many justifications that TST invents, they all follow one consistent thread on formal examination: <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\">If someone talks about The Satanic Temple in terms of its <a href=\"https:\/\/the.satanic.wiki\/index.php\/The_Satanic_Temple#Lawsuits\"><em>actual<\/em> actions and track record,<\/a> rather than merely regurgitating TST&#8217;s own press releases and &#8220;both sides are equally bad&#8221; whitewashing, TST&#8217;s owners and legal team will find \u2014 or just make up out of whole cloth \u2014 an excuse to retaliate. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the Temple&#8217;s claim to simply want back property they (falsely) profess was stolen from them, one of TST&#8217;s final briefings in federal district court was an all-but-explicit admission that their <em>real <\/em>concern was the theoretical harm that might arise from seeing us criticize them on <em>any <\/em>platform. So regardless of whether or not TST had any whiff of a property claim to that platform, such as a working class leftist podcast about Southern history and culture, The Satanic Temple wanted the courts to call discussion of its failures to live up to its own stated values something legally prohibited and at least civily actionable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is not a religion that deserves the benefit of the doubt \u2014 from anyone! \u2014 that it is interested or even capable of advancing the rights of marginalized people anywhere in the country, and certainly not against the oligarch-powered, multi-generational project of Christian fascism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Satanic Temple is not the underdog in this story; they are vastly better-funded as a national organization than we are as a handful of individuals scrapping for donations on GoFundMe and Paypal. <strong>But we keep winning<\/strong>. Every motion, every stage of the case: we win and the Temple loses. And the reason that keeps happening is because despite all of its bloviating about how &#8220;beliefs should follow evidence&#8221; and that &#8220;we believe in Enlightenment rationality,&#8221; <strong>The Satanic Temple simply cannot survive in any arena where it is expected to be able to defend its claims against any kind of sustained, factually-informed pushback.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And yet TST persists with its accusations because, ultimately and by their lawyer&#8217;s own admission, they&#8217;re much less concerned about the merits than they are about retaliating against the very sort of protected speech they claim to value (as long as it&#8217;s pointed at someone else).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Satanic Temple puts incredible weight on their reputation as a counterweight to the Christian Right; it generates countless donations every year on the idea that they can be trusted to protect human rights and social progress via the sheer novelty of &#8220;trolling Christians.&#8221; The Temple generates endless headlines that ultimately do no more than repeat TST&#8217;s press releases and rehash their website&#8217;s &#8220;About Us&#8221; sections, while utterly failing to conduct the necessary follow-up discussion as to how TST&#8217;s supposed theory of change meaningfully benefits anyone outside its owners and inner circle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a common saying on the left: &#8220;<strong>a better world is possible<\/strong>&#8220;. We would argue that the reality is TST has no interest in building a world where it is not in the position to profit from the trauma and desperation of the marginalized, and that its dogged use of SLAPP suits is just one more way it manufactures that trauma in an attempt to profit further. We would argue that this makes TST uniquely and imminently dangerous to people around the country marginalized in so many other ways already.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We think you deserve better than TST. We think the entire world deserves better than TST.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is nothing remarkable about us. We are so utterly mediocre it is almost a joke. Except in one way: <strong>we are the only ones to have been stubborn enough and resourced enough by our allies to fight back<\/strong>. <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\">Our thesis is simple: We refuse to be held liable for damages allegedly caused by things that never actually happened, and especially when conceding would make it easier for TST to perpetrate its structured abuse on anyone else. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And just to clear up a misconception that keeps springing up: we&#8217;re not suing TST. We have <em>always<\/em> been the defendants, legally forced to respond to the complaints made by TST. We&#8217;re not the ones keeping this farce of a suit in court, let alone dragging it into three different courts as of April 2023. TST is the one consciously deciding to file new complaints, refusing to defend its own claims, and then appealing the dismissal that inevitably results, and so the fight continues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legally, TST is comprised of a stack of for-profits and nonprofits owned solely by two men who have admitted in court to operating with no oversight at all &#8211; and over the last several years, they have established a pattern of overt contempt for the legal standards of protected speech, harassing and threatening with financial ruin anyone who draws attention to the numerous problems that flow from an institution arranged in this manner. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"8480\">This writeup, as long as it is, is intended to be a sort of highlight reel \u2014 we want to focus on the most egregious and bad faith arguments that TST makes in this lawsuit, because we think that the very existence of those claims, and the fact that TST finds them compelling enough to present to multiple judges, highlights the Temple&#8217;s fundamentally predatory worldview towards its own members, towards the general public, and towards public institutions like the press and the legal system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And this is all just stuff that&#8217;s already on the record \u2014 either because TST put these facts down itself, or gave us the opportunity to contradict them in sworn statements. David Johnson (23-35060)<\/a> &#8211; Court of Appeals for the Ninth Circuit<\/li>\n<\/ul>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"8992\">Part I<\/h1>\n\n\n\n<h2 class=\"wp-block-heading alignwide\" id=\"8992\">So, what actually happened?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"8480\">This lawsuit involves a conflict between The Satanic Temple \u2014 specifically, its for-profit arm, the <a href=\"https:\/\/the.satanic.wiki\/index.php\/United_Federation_of_Churches,_LLC\">United Federation of Churches, LLC<\/a>, which owns the trademarks to &#8220;The Satanic Temple,&#8221; &#8220;<a href=\"https:\/\/trademarks.justia.com\/885\/74\/lucien-88574615.html\">Lucien Greaves<\/a>,&#8221; &#8220;SatanCon,&#8221; and others \u2014 on the one hand and four former members of TST&#8217;s Washington chapter (hereafter, TST-WA) on the other. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chapters, more recently re-branded &#8220;congregations&#8221;, function largely autonomously with regards to their day-to-day activities, with the crucial exception that, at the time, every chapter had two figures who officially represented the national organization, and who presumably have a signed agreement with the United Federation of Churches, LLC outlining those obligations. <\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/07\/Organizational-Decision-Making-Tree.png\" alt=\"United Federation of Churches Organizational Decision Making Tree\" class=\"wp-image-2287\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image size-full\"><a href=\"https:\/\/the.satanic.wiki\/images\/7\/76\/TST_Organizational_Hierarchy_Structure.pdf\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/07\/TST-organizational-structure.png\" alt=\"The Satanic Temple org char with Executive Ministry ahead of National Council, Chapter Head(s), Media Liaison, then Council, Committee Leads, Committee Members, Members, Volunteers, Attendees,\" class=\"wp-image-2286\"\/><\/a><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Those figures include a Chapter Head and at least one Media Liaison who acts as a co-head of sorts, and focuses specifically on managing media interactions at the local level on behalf of TST itself. <\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/08\/TST-Structure-Censored.png\" alt=\"TST leadership structure with &quot;Executive Ministry&quot; above international council then that over &quot;chapter heads and media liaisons&quot; over &quot;chapter members&quot;\" class=\"wp-image-2378\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In TST-WA, the Chapter Head at the time was Leah Garvais a.k.a. &#8220;Siri Sanguine,&#8221; and the Media Liaison was Paul Case a.k.a. &#8220;Tarkus Claypool.&#8221;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/07\/TST-Leadership-Structure-handdrawn-1024x640.png\" alt=\"\" class=\"wp-image-2285\"\/><figcaption class=\"wp-element-caption\">Leah &#8220;Siri Sanguine&#8221; Garvais explaining TST&#8217;s organizational hierarchy in 2020<\/figcaption><\/figure>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/07\/Paul-Case-aka-Tarkus-Claypool.png\" alt=\"\" class=\"wp-image-2288\"\/><figcaption class=\"wp-element-caption\">The Satanic Temple&#8217;s &#8220;<a href=\"https:\/\/www.facebook.com\/watch\/?v=1596980006991716\">Tarkus Claypool<\/a>&#8220;, left, in 2017, versus <a href=\"https:\/\/www.flickr.com\/photos\/matthetube\/6775752774\/\">Paul Case of the Seattle Skeptics<\/a> in 2011.<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The four former members, now the defendants collectively referred to as QueerSatanic or &#8220;QS,&#8221; are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">David A. The two of importance here are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">The <a href=\"https:\/\/www.facebook.com\/TheSatanicTempleWashington\">TST-WA Facebook page<\/a>, a.k.a. &#8220;the Chapter page&#8221; for the context of this suit, and which was used for messages and posts from TST-WA to the general public. The Chapter page had about 17,000 followers at the time of the lawsuit filing, and was administrated in particular by Johnson.<\/li>\n\n\n\n<li class=\"\">The &#8220;<a href=\"https:\/\/www.facebook.com\/queersatanic\">Evergreen Memes for Queer Satanic Fiends<\/a>&#8221; Facebook page, a.k.a. &#8220;the Memes page&#8221; or &#8220;TST-WA Allies&#8221; for the context of this suit. Prior to November 2019, the Memes page had been used to promote a provisional subgroup of TST-WA called &#8220;South Sound Satanists: Friends of TST,&#8221; which catered to members centered in Tacoma and the southern Puget Sound region more broadly. \n<ul class=\"wp-block-list\">\n<li class=\"\">The subgroup&#8217;s co-chapter head was expelled by Garvais and Case under dubious circumstances in November 2019, and the South Sound subgroup dissolved afterward; the page itself remained largely defunct until December 2019, with less than 500 followers. Defendants Powell and Johnson were made editors of the page in December 2019 by Garvais, and there was a joint agreement by the three of them to repurpose the South Sound Satanists page into a meme-focused page going forward. <em>Powell and Johnson were promoted to administrators of the page by Garvais on Jan. 1, 2020.<\/em> <\/li>\n\n\n\n<li class=\"\">On Jan. 6, 2020, Garvais mistakenly renamed the page to &#8220;TST WA Allies,&#8221; confusing the page with a private Facebook group intended to be used as a discussion forum between members and general public who supported TST&#8217;s missions but did not want to become members themselves. At the same time, the URL for the old South Sound Satanists page was updated correctly to &#8220;facebook.com\/QueerSatanicMemes,&#8221; but the page&#8217;s display name could not be readjusted to match per Facebook waiting periods between page display name changes.<\/li>\n\n\n\n<li class=\"\">On March 14, 2020, the Meme page&#8217;s display name was changed to &#8220;Evergreen Memes for Queer Satanic Fiends,&#8221; its present-day name, in accordance with its intended purpose and URL.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The other two social media of note are a <a href=\"https:\/\/twitter.com\/tst_washington\">TST-WA Twitter profile<\/a> (shared by many but updated primarily by Johnson), and a Gmail address (shared by Garvais, Case, and Fishbaugh).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As of March 2020, to facilitate greater member participation and self-management, TST-WA had been structured to include multiple committees organized for particular functions for the chapter. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time, there were approximately 20 people across seven volunteer committees; all four defendants were committee heads \u2014 notably, Johnson and Powell were heads of the committee dedicated to creating social media content, while Fishbaugh and Sullivan were heads of a committee related to organizing community-service events.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 12, 2020, Garvais sent out an email to all committee heads, announcing her product of an investigation into an internal complaint filed by another committee head. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 14, 2020, she announced this to the rest of the chapter at large.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/09\/image-3.png\" alt=\"Announcement from Siri\nGreetings,\n\nAs some of you may already be aware, I have just recently made the decision to dissolve the Legion Guild and return to our original Strategy Council structure.\n\nThis was a grand experiment, however many of us in the trenches realize that the system, while promising, created more bureaucracy than we wanted and tied our hands when trying to accomplish our important goals. The current groups will remain as a pool for the creation of task forces to be led by members of the Strategy Council. My goal is to streamline our processes so we can get back to our focus - activism, community, and service.\n\nI will be hand-selecting my new council of advisers over the next few weeks, and will make an announcement once my team is complete. Garvais also cited this complaint as the basis to conclude that the person who filed the complaint, as well as the four of us and some others, had formed a &#8220;coalition&#8221; to stir up drama, undermine TST, and harass leadership. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 14, 2020, when asked directly by Powell, Garvais admitted in an email that the four of us were included specifically because we had been CC&#8217;d on the aforementioned complaint. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Garvais also berated Powell specifically for a variety of grievances related to his performance as a committee head, including discussing &#8220;unrelated leftist politics on TST-affiliated social media,&#8221; and specifically mentioned a post on the Allies page discussing ableism from two days prior. <\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/09\/image-5.png\" alt=\"\" class=\"wp-image-2395\"\/><\/figure>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-primary-background-color has-background wp-block-paragraph\">Greetings!<br><br>I&#8217;d really like to know what I did to undermine leadership? Here is some examples for you to consider:<br><br>*Cannot be held accountable for your own guild (IC is aware of how badly the allies page is fucking up), isn&#8217;t worried about being labelled a criminal (and endorses negative and unrelated leftist politics on TST-affiliated social media). TST WA Allies should be about Satanism. On March 4th, this was told to you and ADJ, but just as recently as two days ago, there is a post about ableism. (this as a post from an individual is great &#8211; as TST WA not acceptable).<br><br>*Failed to attend a meeting to specifically address concerns about your guild which you were notified of and agreed to be there weeks in advance, and left ADJ (a non-lead in that guild) to answer for your guild. Your failure to attend that meeting led us to not be able to implement fixes that could have avoided IC catching wind of it&#8217;s off-mission abuse of the Tenets to push personal agendas.<br><br>*As Guild Head of Publicity, you did not initiate, conceive, nor execute ANY publicity campaign for our biggest action in two years.<br><br>*Failed to work with Evergreen for P4P despite being reminded for months and refused help from another member who also is an alum. Didn&#8217;t tell anyone you were out of spoons until the day before a scheduled outing with Barrett (Barrett went alone to the campus in your place even though he is not an alum).<br><br>*Lupercalia- Made Crimson feel like her home was a hotel by asking for a separate room to be made up for you last minute. Spent the night and left without cleaning or informing someone else that cleaning needed to happen. When discussed in Legion, did not own up to your contribution of the problem for several days.<br><br>Personally, I do like you as a person and enjoy your company, but this is &#8220;business&#8221; and I have to set my personal feelings aside and create the best team possible for the chapter. I need people to actually do the things they commit to so no one person gets overloaded, and who can communicate their lack of ability to complete a task with enough time for the group to recover. You have proven yourself incapable of these behaviors so I have adjusted my expectations accordingly.<br><br>Thank you for your understanding,<br>Siri<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Shortly after this email exchange, Powell removed the other administrators from the Memes page besides Johnson, and changed the page name from &#8220;TST WA Allies&#8221; to its current iteration, &#8220;Evergreen Memes for Queer Satanic Fiends.&#8221; In response, Garvais sent an email out to the rest of TST-WA, announcing that Powell had &#8220;stolen&#8221; the page and was now banned from TST nationwide while Garvais awaited further instruction from TST&#8217;s International Council (formerly the National Council).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 15, 2020, Garvais and Case held a Zoom town hall conference within TST-WA, attempting to explain to the rest of the chapter why so many leadership figures had been removed overnight including a founding member. Garvais reiterated in that meeting that our being witnesses to the complaint was the primary motivator for our expulsion. Just let me know.<br><br>Thank you, <br>Siri<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the attempt to control the narrative and member dissatisfaction, the sudden removal of so many prominent local chapter members rubbed many of those who remained the wrong way and they began to leave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the next several days, a few dozen former members of The Satanic Temple \u2014 local and national, new and old \u2014 joined a Facebook group and a new Discord server and began comparing notes about their treatment over the previous five years. That evening, he removed all other admins and editors from what had been the Washington State chapter page, posted his explanation of what was going on, and began to re-post news articles, former member testimony, and the past history of Doug Misicko and Cevin Soling \u2014 all of which showed the dissonance between the way The Satanic Temple described itself and its principles on one hand versus TST&#8217;s and its owners&#8217; actual practices going back decades, on the other. <\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/queersatanic.com-content\/uploads\/2023\/08\/gov.uscourts.wawd_.285026.1.6.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of gov.uscourts.wawd_.285026.1.6.\"><\/object><a id=\"wp-block-file--media-69fb26d9-37b7-4536-80c2-27e39cfa99a7\" href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/08\/gov.uscourts.wawd_.285026.1.6.pdf\">gov.uscourts.wawd_.285026.1.6<\/a><a href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/08\/gov.uscourts.wawd_.285026.1.6.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-69fb26d9-37b7-4536-80c2-27e39cfa99a7\">Download<\/a><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">That evening, Paul Case sent an email asking for the page to be returned, and Johnson did not reply. The following day, TST lawyer Matthew Kezhaya sent a threatening letter claiming the Facebook page was TST&#8217;s website and property, and Johnson did not reply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 3, 2020, United Federation of Churches LLC d\/b\/a &#8220;The Satanic Temple&#8221; filed a federal lawsuit suing Johnson ostensibly over what he had done with the chapter Facebook page, but also Fishbaugh, Powell, and Sullivan.<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"f6b2\">Part II<\/h1>\n\n\n\n<h2 class=\"wp-block-heading alignwide\" id=\"f6b2\">What kind of church sues former members?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"f1ce\">By now, a decade into it, most people will have come across The Satanic Temple already in one way or another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We have already written about <a href=\"https:\/\/queersatanic.com\/when-it-comes-to-the-satanic-temple-theres-always-more-and-its-always-worse\/2\/\">the Temple&#8217;s origins<\/a>, specifically as <a href=\"https:\/\/queersatanic.com\/what-the-hell-is-the-satanic-temple-ep-2-spectacle-films-inc\/\">yet another prank documentary film project<\/a> by a NYC landlord scion that ultimately evolved into a grift with no set end date. <\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-wp-embed is-provider-queer-satanic wp-block-embed-queer-satanic\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"wp-embedded-content\" data-secret=\"y1TLMIE2fJ\"><a href=\"https:\/\/queersatanic.com\/what-the-hell-is-the-satanic-temple-ep-5-the-satanic-temple-inc\/\">What the hell is \u201cThe Satanic Temple\u201d?\u200a\u2014\u200aEp. 5: The Satanic Temple (Inc.)<\/a><\/blockquote><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; This thoroughness may be overkill, but it&#8217;s the only antidote we know to combat TST&#8217;s reliance on exploiting the goodwill and good-faith presumptions of public institutions and the public at large; that&#8217;s what makes it so dangerous to the people who resonate strongest with the Temple&#8217;s public messaging. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We want to be explicit about this in particular: <strong>TST&#8217;s decision to sue us on claims they knew were false <\/strong>\u2014 and their multiple attempts to force the court to issue rulings that it had no legal or even constitutional authority to give  \u2014 <strong>is not merely an issue of <em>hypocrisy<\/em> on TST&#8217;s part<\/strong>. As ham-fisted and unethical as their conduct has been within and around this lawsuit, <strong>the Temple&#8217;s decision to file the suit was perfectly in keeping with how TST itself is structured and how it decides what its priorities actually are<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"ddd6\">Other members and even whole chapters have left the organization, both before and after us (St. Louis, Detroit, Portland, Los Angeles, the United Kingdom), <a href=\"https:\/\/www.reddit.com\/r\/satanism\/comments\/rlb358\/comment\/hph296q\/\">taking all their social media pages with them<\/a> or deleting the accounts outright. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"ddd6\">At least one (Chicago) apparently even took the local chapter&#8217;s <em>physical <\/em>property with them. <\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><a href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/03\/image-12.png\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/03\/image-12.png\" alt=\"The Satanic Temple Illinois Facebook comment: 'It was partly covid and partly because the nutjobs formerly known as \u201cleadership\u201d stole the statue, along with any other TST assets they had access to.'\" class=\"wp-image-1510\" style=\"width:300px;height:undefinedpx\"\/><\/a><\/figure>\n<\/div>\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><a href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/03\/image-13.png\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/03\/image-13.png\" alt=\"[Redacted Facebook profile] For the record: The original Chicago statue was paid for through public fundraising as well as chapter-driven events. Rather, we also talked publicly about some of the other corporations TST\u2019s owners have, and how they actually represent \u2014 and <em>mis<\/em>represent \u2014 themselves on the legal documents that, when put together, give shape to TST as a legal &#8220;religion.&#8221; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"8480\">Moreover, the fact that this was also accompanied by a frank discussion about the common threads between why people have left TST in the past, continue to leave to this day, and how TST is fundamentally set up to hurt people and drive them away in the future \u2014 in front of an audience that TST had probably considered to be safely protected from encountering any real criticism of TST, no less \u2014 posed an immediate, existential threat to TST that probably weighed much more heavily into their ultimate decision to file this suit in federal court than any theoretical (and to this day, unproven) breaches of law.<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"f6b2\">Part III<\/h1>\n\n\n\n<h2 class=\"wp-block-heading alignwide\" id=\"f6b2\">Facebook owns Facebook pages<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As mentioned, The Satanic Temple leans heavily on what are legally known as &#8220;conclusory statements&#8221;. These are <strong>declarations and demands that are intended to be taken at face value, even while their factual and logical supports are missing or even contradictory to the statement<\/strong>. The Temple&#8217;s press releases and the clickbait articles repeating them follow a common theme: &#8220;The Satanic Temple Declares X&#8221; or &#8220;Satanists Announce They Are Exempt From Y.&#8221; It may or may not be a surprise that their approach to making formal legal arguments is equally haphazard, even as this strategy creates an unbroken chain of defeats around the country for the Temple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We think the fact they continue to rely on this strategy in today&#8217;s world is a massive tell as to what they&#8217;re actually out to accomplish.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"f54b\">In our case, The Satanic Temple instigated and then repeatedly prolonged this suit with allegations that have no basis in either fact or law. Let&#8217;s talk about a few of them.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/1\/united-federation-of-churches-llc-v-johnson\/\"><img decoding=\"async\" src=\"https:\/\/miro.medium.com\/max\/570\/0*f_10HNuMG-rjbVB7.png\" alt=\"Facebook refused to correct the matter, mislabeling the issue as a \u201cPage admin issue\u201d to the exclusion of \u201cinfringements of your legal rights.\u201d\n...\nFacebook did not respond and did not correct the issue.\" style=\"width:613px;height:118px\"\/><\/a><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\" id=\"0da3\">It shouldn\u2019t be a controversial statement, but <em>Facebook owns Facebook pages.<\/em> They have a much better ability to detect \u201chacking\u201d or \u201ccyberpiracy\u201d if it had actually occurred. But it didn&#8217;t.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"d40f\">We argued that in court, and both Facebook and the judge agreed with us.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"8c64\">(From TST\u2019s complaint and <a href=\"https:\/\/www.bloomberglaw.com\/public\/desktop\/document\/UnitedFednofChurchesLLCvJohnsonNo220cv00509RAJ2021BL69458WDWashFe\" target=\"_blank\" rel=\"noreferrer noopener\">the judge\u2019s dismissal<\/a>, respectively)<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/miro.medium.com\/max\/613\/0*IECb2nNXy_040zqM.png\" alt=\"iii. facebook.com\/TheSatanicTempleWashington\nThe Satanic Temple owns the trade name &quot;The Satanic Temple.&quot; Dkt. # 1 \u00b6 11. The &quot;domain in question,&quot; it says, is &quot;facebook.com\/TheSatanicTempleWashington.&quot; Dkt. # 12 at 9 (emphasis in original). According to The Satanic Temple, Defendants have commandeered its social media profile and are holding it &quot;hostage.&quot; Id. at 8-12. It now seeks the ACPA's protection.\n\nThis claim fails for one reason. The &quot;domain in question&quot; is not in fact &quot;facebook.com\/TheSatanicTempleWashington.&quot; The &quot;domain name&quot; is &quot;facebook.com.&quot; And The Satanic Temple does not claim to own it. Its trademark lies in the post-domain path, which does not constitute a &quot;domain name&quot; under the ACPA. As explained above, the statute defines the term &quot;domain name,&quot; and the case law provides further clarification. The Satanic Temple's claim fails under both.\n...\nThe ACPA protects against the unauthorized use of a trademark in a domain name. According to the complaint, the trademark here is being used not in a domain name, but in a post-domain path. Those are not the same. The Court has found no authority suggesting that the ACPA extends to any URL component beyond top-level and second-level domains. Indeed, the Court has found the opposite. See GoForIt Entm't, LLC v. DigiMedia.com L.P., 750 F. Supp. 2d 712 , 725 (N.D. Tex. 2010) (&quot;The court has found no case, and [plaintiff] has cited none, that holds that a portion of a web address other than a second or top level domain constitutes a 'domain name' within the meaning of the ACPA.&quot;).\n\nThe Court declines to stretch the ACPA to cover trademarks appearing in vanity URLs or post-domain paths. Because the ACPA is inapplicable, the Court need not address each claim element. The Court DISMISSES the ACPA claim.\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"cfad\"><em><strong>Note<\/strong>: As explained above, the statute defines the term \u201c<a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&amp;height=800&amp;iframe=true&amp;def_id=15-USC-45936743-1913738695&amp;term_occur=999&amp;term_src=\">domain name<\/a>,\u201d and the case law provides further clarification. The Satanic Temple\u2019s claim fails under both. In reverse order, cases in this circuit explain that there are two parts to a domain name: a top-level and a second-level. Post-domain paths like a Facebook page username are not included in that combination.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In plainer language, TST tried to argue that because its trademark (&#8220;The Satanic Temple&#8221;) appears in the part of a Facebook page&#8217;s URL that users can customize for themselves (a.k.a. the vanity URL, legally), someone who runs that Facebook page without express permission from TST is doing cyberpiracy under a law that has repeatedly been understood to exclude vanity URLs from its protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Essentially, TST wanted vanity URLs \u2014 something that can be created and modified by any user on demand, for next to no effort \u2014 to confer federally-protected property rights equal to those held by the people who actually own a website and have registered it within the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Domain_Name_System\">Domain Name System<\/a> (DNS). <strong>Charitably put, this is a stupid argument, and it was unsurprisingly dismissed in the first stage of the case, as we can see above<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both of TST&#8217;s federal claims in the initial complaint (its accusations of hacking and cyberpiracy) revolve around an underlying assumption that if the words &#8220;The Satanic Temple&#8221; appear anywhere in the title or description of a platform, then that platform automatically becomes the <em>de facto<\/em> property of Cevin Soling, the owner of the trademark &#8220;The Satanic Temple&#8221; under his pseudonym &#8220;Malcolm Jarry&#8221; and via his corporation United Federation of Churches LLC, regardless of any actual external definitions of ownership or regardless of the countless people, industries, and legal bodies that have a stake in those definitions. This is a recurring theme that manifests in increasingly ludicrous ways over the course of this lawsuit, but TST&#8217;s theory of retroactive ownership of the volunteer labor of others shows up consistently in other contexts as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The initial complaint was dismissed in <a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/united-federation-of-churches-llc-v-johnson\/#entry-20\">late February 2021<\/a>. Even though The Satanic Temple was given permission to amend the holes in most of its allegations (except defamation, more on that in a bit), TST also opted to file a separate motion to have the cyberpiracy dismissal reconsidered. In an attempt to address the fact the relevant legislation in the &#8220;<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/15\/1125\">Anti-cybersquatting Consumer Protection Act<\/a>&#8221; (ACPA) excludes the vanity URL that TST wanted it to protect, the Temple instead argued out of the blue that, <em>actually<\/em>, the ACPA should be expanded such that Facebook would be considered a &#8220;domain registration authority&#8221; on par with companies like Verisign who register <em>.com<\/em> and <em>.net<\/em> websites with the DNS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our lawyer&#8217;s background includes intellectual property, so he was able to navigate the contours of these laws and oppose the reconsideration without our assistance. Our commentary here is based off the overview of the DNS in the related document:<\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Reconsideration-Opposition-Response.pdf\" type=\"application\/pdf\" style=\"width:100%;height:790px\" aria-label=\"Embed of Reconsideration-Opposition-Response.\"><\/object><a id=\"wp-block-file--media-ec8cfc93-9cb3-4b78-9180-be698bdb13be\" href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Reconsideration-Opposition-Response.pdf\">Reconsideration-Opposition-Response<\/a><a href=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Reconsideration-Opposition-Response.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-ec8cfc93-9cb3-4b78-9180-be698bdb13be\">Download<\/a><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">It&#8217;s beyond our technical knowledge or scope here to talk in detail about what the Temple&#8217;s kind of interpretation would mean, but it&#8217;s also not hard to see at least one clear possible outcome and what sort of interests would have stake in it, outside the petulant and myopic owners of TST. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From our non-expert understanding, the sort of expansion of the ACPA that TST argues for here would implicate <em>millions<\/em> of Facebook pages (and possibly other social media sites as well), and set the stage to make any number of them acceptable targets of frivolous cybersquatting lawsuits simply for having someone else&#8217;s trademark <em>somewhere<\/em> in their vanity URL. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Putting aside meme pages like ours for a second, such a ruling would also give an additional (however minor) weapon for companies to use against, say, consumer advocacy or employee unionization pages as well. Should <a href=\"https:\/\/www.facebook.com\/TargetWorkersUnite\/\">Target Workers Unite<\/a> be able to be accused and possibly bankrupted by a frivolous cyberpiracy lawsuit just because &#8220;Target&#8221; appears in its name and the company wants an easy shortcut to suppressing them? <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Facebook is not the whole Internet, to be sure, but given that it&#8217;s still used for coordinating people with like interests based in targeted, systemic criticism, the argument that TST is making here would set the stage for a nationwide chilling effect on otherwise protected speech \u2014 and at the behest of far worse entities that, like The Satanic Temple, have a vested interest in not being discussed critically by the rest of us. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If TST even considered that possibility and its relationship to its so-called &#8220;freedom to offend,&#8221; they certainly didn&#8217;t let it affect the quality of the argument they actually filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We would argue that it is not only fortunate for us as defendants that TST&#8217;s argument here was dismissed for the farce that it was, but fortunate for everyone else too.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But hey, &#8220;the struggle for justice is an ongoing and necessary pursuit that should prevail over laws and institutions,&#8221; right?<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"TST's-&quot;competitor-organizations&quot;-conspiracy-theory\">Part IV<\/h1>\n\n\n\n<h2 class=\"wp-block-heading alignwide\" id=\"TST's-&quot;competitor-organizations&quot;-conspiracy-theory\">TST&#8217;s &#8220;competitor organizations&#8221; conspiracy fantasy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The initial complaint was catalyzed specifically by the so-called &#8220;hacking&#8221; of the TST-WA Facebook page (a.k.a. &#8220;the Chapter page&#8221;). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TST has never been able to show the involvement of any of the other three people it sued, and conspicuously, repeatedly refused to even try to do so, but it still needed something to point at to make it sound more plausible that this wasn&#8217;t just a case of TST retaliating for direct and substantive criticism against itself by one person. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And so, presumably in order to a.) justify targeting other people with a theoretically endless number of allegations, b.) make that targeting harder and more expensive to defend against, and c.) maximize the hypothetical damages they might be awarded, TST decided that the most convenient rationale was to argue that we had all conspired to form a &#8220;competitor organization&#8221; with the purpose of harming TST and diverting its profit to this theoretical organization instead. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"fc8c\">Now, this is bullshit spun out of whole cloth. The Satanic Temple was given multiple opportunities over more than three years to submit even a shred of evidence that would plausibly suggest that the court should believe such an organization exists at all, and yet TST has never done so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"fc8c\">Similarly, there is not a shred of evidence to support the idea that we colluded to form such an organization because no such agreement was ever made. The burden of proof is on <em>the Temple<\/em> to demonstrate this, and they have never risen to meet it. But TST needs it there in order to connect every otherwise disconnected allegation and defendant that TST has decided to include in its filings over the last three years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"fc8c\">There are probably dozens of Satanist groups around the United States. As far as we know, none of them have ever been sued for being founded or sustained by ex-TST members. None of them have ever had a dollar value put on the head of each person in its membership, and then had the sum of those dollars held up as a legally-actionable &#8220;loss&#8221; by virtue of their not being members of TST instead.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"a1a1\">TST never even attempted to substantiate the allegation of a &#8220;competitor organization&#8221; until it filed its amended complaint in March 2021. In other words, TST waited until after each side had written multiple briefs and after the judge had issued his first ruling, to even <em>pretend<\/em> that it had a factual basis for a &#8220;competitor organization.&#8221; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"f899\">As part of their revised complaint, one of their exhibits is defendant Nathan Sullivan&#8217;s own Facebook post trying to process his removal as he understood it. Because from his end, he \u2014 a founding member of TST Seattle \u2014 had just had his religious community of nearly six years ripped away without warning, notice, or any real chance to speak on his behalf within it. He even said as much in the post they included as evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"adba\">As an aside, we can\u2019t overstate how bitterly amusing it is to see a \u201creligious organization\u201d voluntarily include a post where we accuse it of repeatedly mishandling sexual abuse reports at the local level, reports that we only discovered in the aftermath, by other ex-members coming forward.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"1543\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Nathan-Sullivan-Post-1.png\" alt=\"Nathan Von Sullivan osSopedtnr3t10a119hug7g11i28hr20taa08M8 5cc1a50690c9 gc,f50m \u00b7 Well, apparently I'm no longer affiliated with TST-WA. I always knew that there was an expiration date on my membership, of course, but somehow I kinda expected it to go out with something better than being accused as a co-conspirator of attacking leadership, on the basis of conversations I was no part of and hadn't even seen until after they had resolved (and of course, cannot see any records of now); on the basis of investigations that never contacted me to even attempt to verify either my knowledge, intent, investment, or participation; on the basis of the idea that being CC'd as a witness to a formal complaint, relating to interpersonal conflicts during the proceeding of said conversations, is the same as being party to an intent to cause an internal schism via targeted bullying of particular members (something that can barely be reasonably concluded of the formal complaint itself). There will be probably be more posts as I process this, but for right now I'm speaking solely for myself. All of this has been decided and executed in the possibly-conscious absence of any kind of opportunity made for me to speak in my own defense. I've been on hiatus from TST-WA operations for the last few months while I get some mental health and personal affairs in order - there's nothing like getting into a sleep-deprived fender bender to make you question what your long-term goals are - and so I'd had basically all of our internal comms muted short of being directly tagged. I wouldn't even have known about my removal were it not for one of the other &quot;conspirators&quot; messaging me to ask if I'd *also* been kicked out, prompting me to check and find out that of course I've been removed from said communications, groups, and emails. I understand that there was a town hall meeting where the leadership &quot;discussed&quot; the issue with the rest of the general membership, smoothing over a purge as the necessary handling of a &quot;rogue faction.&quot; Personally, I'm curious as to how multiple people can just go rogue without ever realizing it, but I'm sure the Official Message clarified things in a way that suggests that everything will be fine as long as you accept the official TST-WA theory of leadership that &quot;we are a democracy, but to a point.&quot;\" class=\"wp-image-1543\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"1544\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Nathan-Sullivan-Post-2.png\" alt=\"If there is a central tension these events and conflicts revolve around, it is in the question, &quot;What do we owe to our former members? And what do we owe to our current members such that they don't become former members?&quot; And the official answer to that keeps consistently being, &quot;Nothing, because we didn't do anything wrong and you just need to trust that we have the best intentions on the basis of our mission against religious overreach, even as our internal culture increasingly fosters an environment where people are afraid to make systemic critiques and cannot trust that their reports won't be immediately castigated as proof of malicious intent and punished unilaterally.&quot; Don't complain, don't speak up, don't &quot;give the right more ammunition,&quot; don't be one more example of how ThE LeFt Is EaTiNg ItSeLf, and for the love of Cthulhu don't ever suggest that the call is coming from inside the house, via people whose primary models for organization seem to be the same authoritarian structures that we are all forced to survive in under late capitalism. If you cannot be reaped for social capital then you are chaff - but never question the morality of the scythe, which is merely being pragmatic. I've been fielding messages from the general membership for the last day or so, asking what the fuck is going on. You know what the fucking gross thing is? There are multiple people who have since come forward, telling me about reports they've made of sexual harassment within TST-WA. They didn't report them to me, a glorified middle-manager, and that is absolutely both their right and the right decision. They entrusted it directly to the top leadership, leadership who is empowered by our national coordinators to act quickly and unilaterally in a crisis - leadership who then did nothing with those reports, even as they came in repeatedly, and who sat by as the perpetrators continued to attend meetings in, as far as the rest of us knew, good standing. Leadership who is even now telling the remaining members to trust them as they purge the calls to do better, because TST-WA is &quot;a democracy, but to a point.&quot; These people WERE members in good standing \u2013 up until the point they realized their reports would never be taken seriously, at which point they became former members to whom TST-WA defaults to owing nothing: not the empathy in the First Tenet, not the struggle for justice of the Second, nor the nobility of action and thought of the Seventh.\" class=\"wp-image-1544\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"1545\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Nathan-Sullivan-Post-3.png\" alt=\"TST-WA is and has always been a volunteer organization, but that means leadership must be MORE sensitive to the morale and the lived experience of both its current and former membership, more willing to err on the side of making amends - not less. Which of the tenets, exactly, would be violated by doing so? How is the grand mission against arbitrary authority compromised by an internal culture that gives the benefit of the doubt to someone who is already marginalized by society in so many other contexts? One of the guiding principles of Satanism is that religion and morality do not occur in a vacuum that only opens from the top \u2013 you will forget this at your peril. I will not be appealing my removal. I will not aid in facilitating a half-assed coverup that has the end result of normalizing a power structure that has made a habit of shooting first and then telling the victims that they\u2019re free to ask questions later, maybe. This purge was not a mistake whose harm needs to merely be resolved. This was a statement of intent, a statement of what social arrangement is considered normal by those in power, and what will be done to defend it \u2013 and what will be ignored in the process of defending it. And supposing that I \u201cwon\u201d the appeal and cleared my name, we all know exactly that the price of returning would be the expectation of silence about what happened, how it happened, and most importantly, whether the environment that exists might cause it to happen again. Another of the guiding principles that drives Satanic activism is the idea that silence is consent. They didn\u2019t report them to me, a glorified middle-manager, and that is absolutely both their right and the right decision. They entrusted it directly to the top leadership, leadership who is empowered by our national coordinators to act quickly and unilaterally in a crisis\u2026who sat by as the perpetrators continued to attend meetings in, as far as the rest of us knew, good standing. \u2026 These people WERE members in good standing \u2014 up until the point they realized their reports would never be taken seriously, at which point they became former members to whom TST-WA defaults to owing nothing: not the empathy in the First Tenet, not the struggle for justice of the Second, nor the nobility of action and thought of the Seventh.<\/p>\n<cite>Excerpt from Nathan Sullivan Facebook post, <a href=\"https:\/\/www.courtlistener.com\/docket\/17042463\/26\/5\/united-federation-of-churches-llc-v-johnson\/\">March 15, 2020<\/a><\/cite><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"9e54\">But ultimately, The Satanic Temple focuses on this exchange to support their allegation of a rival organization \u2014 again, in an actual federal court document:<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/image-1024x490.png\" alt=\"[redacted name] But the question is, will you found an actual organization The Satanic Temple 2: Electric Boogaloo?\nThe Satanic Temple 2: The Second one?\nS2: The Mighty Satanists?\n\nNathan Von Sullivan: Satanism Reloaded actually\" class=\"wp-image-1546\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"c704\">The Temple talks a lot about how it values beliefs being informed by available evidence, but that comment is the <em>sole<\/em> basis for the idea that \u201cTST 2: Electric Boogaloo\u201d actually exists and harms them: a throwaway comment by someone 1400 miles away, who isn\u2019t even a defendant, who has never been involved with TST in the first place, being contradicted directly by that defendant.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Provisional-Competitor-Organization-1024x333.png\" alt=\"\" class=\"wp-image-1549\"\/><\/figure>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-accent-background-color has-background wp-block-paragraph\" id=\"c363\">78. Defendants were aware that the social media accounts had an economic value to TST. The social media accounts were the primary means for TST to communicate with the general public and TST\u2019s supporters and Defendants personally used those social media accounts for the purpose of assisting TST in creating the kind of communications that help to foster the kind of relationship which results in charitable donations to support TST\u2019s organizational purposes. By depriving TST of its social media accounts, <strong>Defendants intended to diminish those donations and divert donations to their competitor organization, provisionally named \u201cThe Satanic Temple 2: Electric Boogaloo.<\/strong>\u201d Exhibit 5 at p. 4.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"b217\">If anything makes it clear that this is a SLAPP suit where merits don\u2019t matter, it should be a religion claiming to be threatened by <a href=\"https:\/\/en.wikipedia.org\/wiki\/Breakin%27_2:_Electric_Boogaloo\" rel=\"noreferrer noopener\" target=\"_blank\">a nigh-40-year-old movie reference<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"1dbc\">They put this on the federal record, right next to their tenets about how great they think reason and evidence are.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/queersatanic.com-content\/uploads\/2023\/04\/Competitor-Organization-1024x584.png\" alt=\"\" class=\"wp-image-1547\"\/><\/figure>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-accent-background-color has-background wp-block-paragraph\" id=\"7fee\">111. <strong>Defendants\u2019 competitor organization, which was provisionally entitled \u201cThe Satanic Temple 2: Electric Boogaloo\u201d<\/strong> and \u201cSatanic Washington \u2014 Archived Temple Chapter\u201d had a likelihood of impairing the distinctiveness of TST as a famous mark. To-wit:<br>(1) \u201cThe Satanic Temple 2: Electric Boogaloo\u201d directly copies \u201cThe Satanic Temple;\u201d and \u201cSatanic Washington \u2014 Archived Temple Chapter\u201d (emphasis added) directly suggests that the Washington Chapter has been replaced by Defendants\u2019 competitor organization.<br>(2) TST has an inherently distinctive mark because there is only one \u201cThe Satanic Temple,\u201d Plaintiff, which has acquired distinctiveness as a mark through years of effort.<br><strong>(3) There is only one \u201cThe Satanic Temple\u201d because TST jealously guards its intellectual property rights<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">As of April 2023, TST is now also suing us in state court, and <em>still <\/em>insists that there is a competitor organization called &#8220;The Satanic Temple 2: Electric Boogaloo&#8221; running around collecting imaginary profits that TST supposedly had dibs on. Absolutely pathetic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"78d1\">By the way, keep that last clause in mind \u2014 their claim that there is \u201conly one The Satanic Temple\u201d \u2014 because it\u2019s not really true. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"78d1\">And we\u2019re going to come back to why towards the end.<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<h1 class=\"wp-block-heading alignwide\" id=\"becf\">Part V<\/h1>\n\n\n\n<h3 class=\"wp-block-heading alignwide\" id=\"A-pattern-of-behavior\">A pattern of behavior<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"083b\">Let\u2019s talk about the shitty way The Satanic Temple admits to treating members even without suing them. The neat thing is that their admission of this abuse is also part of the court record. Once again, it&#8217;s there because TST put so much of it there themselves, whether directly or by giving us the opportunity to include it ourselves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"9c68\">TST kicked out the four of us \u2014 <a href=\"https:\/\/nitter.net\/SnailWhisperer\/status\/1418275656920485888\" target=\"_blank\" rel=\"noreferrer noopener\">and several others<\/a> \u2014 because we had been witnesses to an internal ethics complaint that made the regional leadership look bad. This was in part because it brought to light the mishandling by the same leadership of a complaint about persistent sexual harassment from years earlier. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It&#8217;s not even an exaggeration to say this. The Chapter Head of TST-WA at the time, Leah &#8220;Siri Sanguine&#8221; Garvais, explicitly said as much in a Zoom meeting that that&#8217;s why it happened. Here is her statement from that meeting:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote has-accent-background-color has-background is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-accent-background-color has-background wp-block-paragraph\">As of last night, the people who we have locked down and gave the boot off of our server, and out of our Google Group, and denied access to the Google Drive, are Lenore, their partner [Redacted 1], [Redacted 2], ADJ, Nathan, and Leah F. And the reason that those people are in that group is because they were all CC\u2019d on the complaints filed by [Redacted 2], working with [Redacted 2] to cause drama. And until we can suss out what their true roles and motivations are on an individual basis, we are gonna protect the chapter.<br><br>&#8230;<br><br>I think we\u2019re totally open to critique. And I think what kinda draws the line, and how those people got into that coalition grouping, was being included by [Redacted 2] in that email. And until we can chat with them individually, it was just a matter of safety and control, quite frankly.<\/p>\n<cite>Leah Garvais\/Siri Sanguine, then-Chapter Head of the TST-WA congregation<\/cite><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">We attached that meeting to our filing, and it exists as a thumb drive stored with the clerks at the federal court, but you can also download it yourself at this <a href=\"https:\/\/www.dropbox.com\/s\/ruv652yuz5x0pzv\/GMT20200315-220437_Town-Hall-_640x360.mp4?dl=0\">Dropbox link<\/a>, which is what we provided our lawyer when we were finally able to submit this into the record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a religion purging members for being witnesses to abuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a religion making the decision at both the local and national level that the real problem with abuse isn&#8217;t that it happened, but that there were witnesses who might speak up about it and so tarnish TST&#8217;s reputation as a counter to religious abuse of power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a religion deciding that <em>actually<\/em>, the fire alarm is the real problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One more thing to note is that nobody from TST-WA \u2014 not Garvais or anyone else representing them \u2014 actually ever took the time to &#8220;suss out our true roles and motivations.&#8221; TST never contacted or questioned anyone despite having been kicked out <em>explicitly <\/em>for being copied on an email, or, perhaps more egregiously, kicked out for being <em>related <\/em>to someone who was copied in an email. It was simply expected to be swept under the rug that Garvais purged several members under the pretense of an emergency threat to the chapter where being copied on an email was all the proof anyone needed of a &#8220;rogue coalition&#8221; (now &#8220;competitor organization&#8221;) that existed solely to &#8220;cause drama,&#8221; and that this was supposed to be the end of the discussion because she knew best.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is reinforced further in <a href=\"https:\/\/nitter.net\/SnailWhisperer\/status\/1418275656920485888\">this Twitter thread<\/a> by another member, whom we know to have been there both before and after our expulsion, and who ultimately left in disgust because despite assurances from TST-WA leadership that a more detailed investigation and explanation of our removal would be forthcoming, what apparently emerged instead was a cover story that we had been kicked out for being &#8220;violent ANTIFA members.&#8221; The actual details (and any records of them) seem to have been memory-holed altogether by the leadership of TST-WA and their loyalists. <\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\nhttps:\/\/twitter.com\/SnailWhisperer\/status\/1418275656920485888\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In all likelihood, anyone who joined the congregation afterward is completely in the dark that anything ever happened, and if they&#8217;re being told anything, it&#8217;s that there are bogeymen to stay away from &#8211; that there are &#8220;shitteners&#8221; who &#8220;wanted to make TST into something that it wasn&#8217;t,&#8221; or some other boilerplate fig leaf to avoid talking about how the Temple got to where it is today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"9e59\">Both internal ethics complaints had been filed in \u201cthe proper channels\u201d \u2014 but this time, the fact that the victim wanted to include anyone else for transparency\u2019s sake exposed that the existing leadership only intended \u201cthe proper channels\u201d to be a black box by which to make complaints disappear. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"9e59\">Incidentally, this is something worth keeping in mind when talking about any organization, at any level of society: <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\" id=\"9e59\">Ownership determines how something is used, and when the people who run that organization emphasize that speaking up about abuse will only be considered legitimate to the extent that they&#8217;re sent through &#8220;the proper channels,&#8221; <strong>the part that&#8217;s being left unsaid is that what makes those channels &#8220;proper&#8221; is that they are ultimately controlled by people who have a vested interest in pretending that those concerns don&#8217;t exist, and who want to be able to isolate and retaliate against abuse victims as quietly as possible to maintain that appearance.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"85a0\">In our case, all of the witnesses \u2014 everyone outside the intended black box of &#8220;the proper channels&#8221; \u2014 were removed without any more notice than it took to be accused of forming a rogue faction to bully\/undermine leadership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"092f\">The two people at the top of the local hierarchy&#8217;s notion of an investigation into a rogue faction involved unilaterally removing Nathan \u2014 a founding member of The Satanic Temple\u2019s Seattle chapter over five years ago, who created room for dozens of new people looking for a community\u2014<em>while he was on medical leave<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"9254\">At least one person who was removed hadn\u2019t even been CC\u2019d on the ethics complaint, but was dating someone who was. That was just enough to implicate them as a loose end, apparently, and so that person was removed in the same manner as well. <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\">To be as blunt as possible, this is a church covering up reports of abuse by expelling people simply for being in a potential position to find out that abuse was occurring. Anyone who might be tempted to launder this as unfortunate but necessary, Machiavellian <em>realpolitik <\/em>even, should stop and ask themselves whether they&#8217;d be so charitable to the same circumstances unfolding out of a nearby Christian church instead.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"02a4\">Local leadership was in such a hurry to disappear the ethics complaint \u2014 itself ultimately connected to the handling of sexual harassment of a past member who left after months of it going unaddressed! \u2014 and to manage the narrative to remaining members that they didn\u2019t even care that some of the \u201cwitnesses\u201d were the admins of TST\u2019s local social media.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"089f\">A week later, with no direct contact, they still were.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"849c\">In their amended complaint, TST chose to reduce all of this as \u201corganizational failures\u201d and \u201cinflammation of interpersonal conflicts\u201d on our part. And they have been running around ever since, holding up the idea that this theoretical conduct is proof of an alleged conspiracy between the four of us to hurt TST, and using that as the basis for multiple claims in multiple lawsuits across federal, state, and appeals court. But to put as fine a point on it as possible: <\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\"><em>There are multiple people within TST who knew that these allegations were false before the first lawsuit was ever filed.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"58e9\">The fact that multiple claims were repeatedly dismissed, either because TST failed to state any factual basis for them or because they outright refused to when given the opportunities, makes a lot of sense in light of our removal as it actually occurred \u2014 as a cover-up of abusive and negligent leadership. This lawsuit is just doubling down on it because we elected to fight back and refuse to be held liable for theoretical damages caused by things that never actually happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"9ced\">The farcical, paranoid notion of \u201cThe Satanic Temple 2: Electric Boogaloo\u201d is just an expensive, scaled-up version of the story used to justify expelling us: that exposing systemic abuse in a way that can\u2019t be ignored is the act of a \u201crogue faction\u201d that needs to be suppressed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As far as we&#8217;re aware, the people who directly mishandled the original sexual harassment complaint are still in power at TST&#8217;s Washington congregation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"22b4\">If you still think TST is an organization capable of confronting the damage posed by the religious right with any level of integrity \u2014 well, we&#8217;ve got bad news for you, friend.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A detailed look at TST\u2019s case United Federation of Churches, LLC v.
